In short
- DeskShift is licensed to you for personal use through the App Store.
- The Free tier is free forever. Pro is a one-time purchase that unlocks all current and future Pro features for as long as DeskShift is on the App Store.
- DeskShift moves a physical piece of furniture — please keep hands, pets, and fragile things clear when it does.
- The app is provided “as is”, without warranty. You use DeskShift entirely at your own risk and take full responsibility for anything that happens while you use it.
- I’m one person. If something is wrong, email me and I’ll do my best to help.
1. Who these terms are between
These terms are an agreement between you and the developer of DeskShift (the “App”), an independent solo developer based in Romania (“I”, “me”, “my”). The developer’s identity as the seller of the App is disclosed on the App’s App Store listing. By downloading, installing, or using the App, you agree to these terms. If you don’t agree, don’t install or use the App.
The App is distributed exclusively through Apple’s App Store. Apple’s Licensed Application End User License Agreement (the “Apple EULA”) also applies to your use of the App. If anything in these terms conflicts with the Apple EULA, the Apple EULA controls only with respect to Apple’s role (see section 9); otherwise, these terms control.
2. License
I grant you a personal, non-exclusive, non-transferable license to install and use DeskShift on any device that you own or control and that is signed in to your Apple ID, in accordance with the Apple EULA.
You may not:
- Reverse engineer, decompile, or attempt to derive the source code of the App, except to the extent that applicable law expressly permits.
- Rent, lease, sublicense, sell, or redistribute the App.
- Remove or alter any copyright, trademark, or other proprietary notices.
- Try to defeat, bypass, or share the Pro entitlement check.
- Use the App in any way that violates applicable export-control or sanctions laws.
3. Free, trial, and Pro
DeskShift uses a freemium model:
- Free tier — free forever. Includes manual desk control, the Sit and Stand presets, basic Posture Coach notifications, launch at login, and auto-reconnect.
- 14-day Pro trial — every new install gets full Pro features for 14 days, free of charge. I use your Apple ID and iCloud account to track trial state, so the trial does not restart when you reinstall the App or install it on another device signed in to the same Apple ID. In rare cases (for example if iCloud is unavailable for an extended period) this tracking may fail.
- Pro upgrade — a one-time, non-consumable In-App Purchase. Once you buy Pro, every Pro feature stays unlocked on every device signed in to the same Apple ID, including any Pro features I add in future updates (“lifetime feature parity”), for as long as DeskShift remains commercially available on the App Store and continues to receive updates from me.
Pricing and purchases are handled by Apple through the App Store. Refunds are handled by Apple under their refund policy — please contact Apple Support to request one.
4. Your desk
DeskShift controls a motorized standing desk over Bluetooth. The App is designed for desks based on the Linak BLE protocol used in the IKEA IDÅSEN line. Compatibility with other desks is best-effort and not guaranteed. IKEA or Linak may release firmware updates that change the BLE protocol; I make no commitment to support every firmware revision and may drop support for older or newer firmware without notice.
Please use common sense when moving the desk:
- Keep hands, fingers, cables, pets, and fragile objects clear of the desk’s range of motion.
- Make sure monitors, lamps, and anything else on the desk are stable before triggering a move.
- The desk’s own anti-collision sensor is the primary safety mechanism. DeskShift will stop a move if the desk reports a collision, but you should not rely on the App as a safety device.
You are solely responsible for the safe use of your desk and for everything in its range of motion. By using DeskShift you accept all risk arising from any movement of the desk, including damage to the desk itself, to monitors, computers, cables, or anything else on or near the desk, to walls, floors, or surroundings, and any injury to yourself, other people, or animals. I am not liable for any of these outcomes. See sections 7 and 8 below.
5. Trademarks and third-party brands
DeskShift is an independent app and is not affiliated with, endorsed by, or sponsored by IKEA, Inter IKEA Systems B.V., or Linak A/S. “IDÅSEN” is a trademark of Inter IKEA Systems B.V. Any reference to these brands in the App or its marketing is purely descriptive — to tell you what hardware the App is compatible with.
Apple, iCloud, and App Store are trademarks of Apple Inc., registered in the U.S. and other countries.
6. iCloud sync
DeskShift requires iCloud and syncs your desks, presets, and preferences to your own private iCloud container using Apple’s CloudKit framework. I have no access to that data. iCloud availability, performance, and storage limits are governed by Apple’s terms, and I am not responsible for iCloud outages, sync delays, sync conflicts, or any loss or corruption of data caused by iCloud, CloudKit, or your Apple ID configuration. 7. Your responsibility and assumption of risk
By downloading, installing, or using DeskShift you agree that you use it entirely at your own risk and that you accept full responsibility for all consequences of using it. This includes, without limitation:
- Any movement of the desk and any resulting damage, loss, or injury (see section 4).
- Your choice of desk, hardware, firmware, device, and any other equipment, and whether DeskShift is compatible or suitable for them.
- Bluetooth pairing, the local Bluetooth environment, and any interference, disconnection, or unexpected behavior of your desk.
- Your use, configuration, or non-use of the Posture Coach, presets, gestures, keyboard shortcuts, and notifications. DeskShift is not a medical, ergonomic, or safety device, and any health, posture, or wellness outcome is your responsibility.
- Your iCloud setup and any loss, corruption, duplication, or unavailability of data stored on your device or synced through iCloud. You are responsible for your own backups.
- Compliance with any law, regulation, workplace policy, lease, warranty, or third-party agreement that applies to you, your desk, or your environment.
To the fullest extent permitted by law, you agree to defend, indemnify, and hold me harmless from and against any and all claims, demands, damages, losses, costs, and expenses (including reasonable legal fees) brought by you or any third party and arising out of or related to your use of DeskShift, your violation of these terms, or your violation of any right of another person.
8. Disclaimer of warranty and limitation of liability
DeskShift is provided “as is” and “as available”, without warranty of any kind, express or implied, including but not limited to fitness for a particular purpose, merchantability, non-infringement, accuracy, reliability, or that the App will be uninterrupted, error-free, secure, or compatible with every desk, firmware revision, operating system version, or future Apple platform change.
To the maximum extent permitted by law, I am not liable for any direct, indirect, incidental, special, consequential, exemplary, or punitive damages — including loss of data, lost profits, lost time, damage to your desk or equipment, damage to property, or any personal injury — arising out of or related to your use of, or inability to use, the App, even if I have been advised of the possibility of such damages. My total cumulative liability for any and all claims related to the App will not exceed the amount you actually paid me for Pro (or, if you only use the Free tier or trial, zero).
Nothing in these terms limits any liability that cannot be limited under applicable law, including your consumer rights under Romanian and EU law.
9. Apple’s role
DeskShift is sold through Apple’s App Store, but Apple is not a party to these terms and provides no warranty or support for DeskShift. The way responsibility splits between Apple and me — including maintenance and support, warranties, product- and IP-related claims, your end-user representations (such as export-control and sanctions compliance), and Apple’s status as a third-party beneficiary entitled to enforce this EULA — is governed by Apple’s Licensed Application End User License Agreement, which you also agree to (see section 1). Those terms are maintained by Apple and may change from time to time.
For clarity, this section is only about the split of responsibility between me and Apple. It does not expand, reduce, or override the liability disclaimers in sections 7 and 8 — you still use DeskShift entirely at your own risk, and my liability to you remains capped as set out above.
10. Governing law and disputes
These terms are governed by the laws of Romania, without regard to its conflict-of-laws rules. Any dispute arising out of or related to these terms or your use of DeskShift will be brought in the courts of Romania.
If you are a consumer, you also have the benefit of any mandatory protections of the law of the country where you live, including the right to bring a claim in the courts of your home country where local consumer-protection law requires. Nothing in these terms reduces those rights.
11. Changes to the App and these terms
I may release updates, add or change features, or discontinue features over time. When that happens I’ll try to give a heads-up in the release notes.
I may also update these terms. If I make material changes, I’ll update the “Last updated” date at the top and call out the change in the App’s release notes. Your continued use of the App after the change means you accept the updated terms. If you don’t agree to the updated terms, please stop using the App.
12. Termination
You can stop using DeskShift at any time by uninstalling it. I can terminate this license if you materially breach these terms — for example by reverse-engineering the App, redistributing it, or trying to defeat the Pro entitlement check. On termination, the license in section 2 ends; your data on your device and in your iCloud is still yours.
13. General
- Severability. If any part of these terms is held unenforceable, the rest stays in full effect.
- No waiver. If I don’t enforce a part of these terms right away, that doesn’t waive my right to enforce it later.
- Entire agreement. These terms, together with the Apple EULA and the Privacy Policy, are the full agreement between you and me about DeskShift, and replace any earlier agreements on the same topic.
- Assignment. You may not transfer your rights under these terms to anyone else. I may transfer mine — for example if I sell or restructure DeskShift — and these terms will continue to apply to you under the new owner.
- Force majeure. I am not liable for failures or delays caused by events outside my reasonable control, including Apple platform outages, iCloud outages, network failures, or acts of government.
